"Upon him is that he ensures security"

Qadhi Abu Ya'la al-Hanbali said:

وإذا دخل ـ أي المسلم ـ دار الحرب بأمان، أو كان مأسوراً معهم فأطلقوه وأمنوه، لم يجز أن يغتالهم في نفس ولا مال، وعليه أن يؤمنهم كما أمنوه

ENGLISH:

"If – any Muslim - enters into Dār al-Harb with security (Amān) or he was taken as captive with them and then released and given security, it is not allowed that he kills them or take their wealth, upon him is that he ensures security as they do so to him".

NEDERLANDS:

"Als een moslim de daarul-harb binnentreedt met een vredesverdrag (’aman), of als hij als gevangene was genomen en toen werd vrijgelaten en veiligheid was aangeboden, dan mag hij hun niet doodmaken of hun bezittingen afpakken! Zij moeten veilig zijn bij hem, net zoals hij veilig was bij hun".
