"he blood of Bani Adam is sanctified"

Ibn Taymiyah says:

وهذا وجه حسن دقيق فان الاصل ان دم الادمي معصوم لا يقتل الا بالحق وليس القتل للكفر من الامر الذي اتفقت عليه الشرائع ولا اوقات الشريعة الواحدة كالقتل قودا فانه مما لا تختلف فيه الشرائع ولا العقول وكان دم الكافر في اول الاسلام معصوما بالعصمة الاصلية وبمنع الله المؤمنين من قتاله ودماء هؤلاء القوم كدم القبطي الذي قتله موسى وكدم الكافر الذي لم تبلغه الدعوة في زماننا او احسن حالا من ذلك وقد عد موسى ذلك ذنبا في الدنيا والاخرة مع ان قتله كان خطا شبه عمد او خطا محضا ولم يكن عمدا محضا

ENGLISH:

"The foundation is that the blood of Bani Aadam is sanctified and inviolable and no one is killed except with right. Killing due to kufr is not something which the legislations have agreed upon at any one time of the Shariah, such as killing the one who sits out of combat, for this is something that the legislations and intellect do not differ over. The blood of a disbeliever during the early history of Islaam was sanctified and inviolable just like the original sanctity of a person. Allaah prevented the Muslims from killing such a disbeliever".

"De originele regel is dat het bloed van de kinderen van Adam beschermd en onschendbaar is en niemand gedoodt mag worden behalve met recht. Iemand doden wegens kufr is iets waar onze wetgeving het nooit mee eens is geweest, zoals het doden van degenen die niet meedoen aan de strijd. Dit is iets waar de wetgeving en de ‘aql (verstand) niet over verschillen (dat het niet goed is). Het bloed van de kuffar was tijdens het begin van de Islaamitishe geschiedenis beschermd en onschendbaar, net zoals het oorspronkelijk onschendbaarheid van een mens. Allaah weerhield de Moslims van het doden van zulke kuffaar".
